Types of Injury Compensation
If an injury claim is successful a Claimant can expect to receive two principal elements of compensation (“general damages” and “special damages”) although there are other “heads of loss” that may apply to particular circumstances.
Special Damages Compensation
Special damages compensate an accident victim for quantifiable losses such as loss of earnings or care, medical and travel costs.
General Damages Compensation
General damages are meant to compensate a victim for pain, suffering and loss of amenity. This award is calculated by reference to guidelines called the Judicial College’s Guidelines for the Assessment of General Damages as well as previous Court awards that have been made. The guidelines provide broad brackets which suggest the likely figure. Ultimately the Court’s discretion is used to make an award if an agreement cannot be reached.
